1. Introduction

These Terms & Conditions ("Terms") govern your use of Paicer ("we", "our", or "us"), an AI-powered workout management application operated as a sole trader under the laws of England and Wales.

By creating an account or using our services, you agree to be bound by these Terms. If you do not agree, please do not use Paicer. These Terms should be read alongside our Privacy Policy, which explains how we collect and use your data.

2. Account Registration

To use Paicer, you must create an account and verify your email address. By registering, you confirm that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)
  • The information you provide is accurate and complete
  • You are responsible for maintaining the security of your account credentials
  • You will notify us immediately of any unauthorised use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

3. Service Description

Paicer provides AI-powered tools for runners to manage their training. Our services include:

  • Workout Parsing: Upload images of training plans and our AI extracts structured workout data
  • Smartwatch Sync: Sync parsed workouts to your Garmin Connect™ calendar
  • Workout Scheduling: Drag-and-drop calendar for organising your training
  • Pace Zone Management: Create and manage custom pace zones with intelligent alias matching
  • Free Tools: Pace calculator, race predictor, and pace zone calculator available without an account

Features may be added, modified, or removed over time. We will provide reasonable notice of any material changes that affect your use of the service.

4. Subscription Plans & Billing

4.1 Available Plans

Paicer offers the following subscription plans:

  • Free Trial: 14 days of full access with 10 upload credits. No credit card required.
  • Monthly: $4.99 per month. 10 upload credits per month.
  • Yearly: $49.99 per year. 10 upload credits per month.
  • Lifetime: $99.99 one-time payment. 10 upload credits per month, forever.

4.2 Upload Credits

Upload credits are used when you parse workout images using our AI. Each image upload consumes one credit. Unused credits do not roll over between billing periods.

4.3 Payment Processing

All payments are processed securely by Paddle, our payment provider. By subscribing, you also agree to Paddle's Terms of Service. Prices are displayed in US dollars and may be subject to local taxes as determined by Paddle.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Monthly and Yearly plans: You retain access until the end of your current billing period. No further charges will be made.
  • Lifetime plan: There is no recurring billing to cancel. Your access continues indefinitely.

4.5 Price Changes

We may change subscription prices from time to time. Any price changes will take effect at your next billing cycle, and we will notify you via email at least 30 days in advance. Lifetime plan pricing is locked at the time of purchase.

5. Refund Policy

5.1 Free Trial

The free trial requires no payment and does not automatically convert to a paid plan. There is nothing to refund.

5.2 Monthly & Yearly Subscriptions

You may request a full refund within 14 days of your initial purchase or most recent renewal. No questions asked.

After 14 days, no refund will be issued. You may cancel your subscription at any time and continue to use the service until the end of your current billing period.

5.3 Lifetime Plan

You may request a full refund within 14 days of purchase. No questions asked. After 14 days, no refund will be issued.

5.4 How to Request a Refund

To request a refund, contact us at support@paicer.app with your account email and reason for the request. Approved refunds are processed within 5-10 business days via your original payment method through Paddle.

5.5 Service Disruption

If Paicer is materially unavailable for an extended period due to an issue on our end, affected subscribers may request a full refund regardless of the above timeframes.

6. Acceptable Use

When using Paicer, you agree not to:

  • Use the service for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble any part of the application
  • Use automated tools, bots, or scripts to access the service or consume credits
  • Resell, redistribute, or sublicense access to Paicer
  • Upload content that is illegal, harmful, or infringes on the rights of others
  • Attempt to circumvent usage limits, credit systems, or security measures
  • Interfere with or disrupt the service or its infrastructure

Violation of these terms may result in immediate suspension or termination of your account.

7. Third-Party Integrations

Paicer integrates with third-party services to provide its features:

We are not responsible for the availability, accuracy, or functionality of third-party services. If a third-party service becomes unavailable, certain Paicer features may be temporarily affected.

8. Your Content & Data

8.1 Ownership

You retain ownership of all workout data, training plans, and other content you create or upload to Paicer. We do not claim any intellectual property rights over your content.

8.2 Licence to Us

By uploading content to Paicer, you grant us a limited, non-exclusive licence to process, store, and display that content solely for the purpose of providing the service to you. This licence ends when you delete your content or close your account.

8.3 AI Processing

Workout images you upload are sent to Anthropic's Claude AI for parsing. Images are processed in real time and are not stored by us or Anthropic beyond what is necessary to complete the parsing request.

9. Intellectual Property

All rights, title, and interest in the Paicer application — including its design, code, features, branding, and documentation — remain the exclusive property of Paicer. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.

10. Disclaimer of Warranties

Paicer is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

In particular, we do not warrant that:

  • The service will be uninterrupted, error-free, or available at all times
  • AI-parsed workout data will be 100% accurate — you should always review parsed workouts before syncing
  • Synchronisation with Garmin Connect™ will always succeed, as this depends on third-party availability
  • The service constitutes professional coaching, medical, or fitness advice

11. Limitation of Liability

To the fullest extent permitted by law, Paicer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to:

  • Loss of data, training plans, or workout history
  • Missed workouts or training disruptions due to sync failures
  • Inaccurate workout parsing or pace zone assignments
  • Injuries or health issues arising from following AI-parsed workout plans
  • Unavailability of third-party services (Garmin Connect™, Paddle, etc.)

Our total liability to you for any claims arising from or related to these Terms or the service shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under the laws of England and Wales.

12. Account Termination

12.1 By You

You may delete your account at any time through your account settings or by contacting us at support@paicer.app. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

12.2 By Us

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Where possible, we will provide notice before taking such action.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page
  • Notify you via email if you have an account with us
  • Display a prominent notice on our website where appropriate

Your continued use of Paicer after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or your use of Paicer shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you retain any mandatory protections provided under the law of your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

15. General

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Paicer regarding the use of the service.
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to a successor in connection with a business transfer.
